GENERAL COUNSEL

JOB SUMMARY

The General Counsel is responsible for managing the legal affairs of US HealthVest, a leading provider of behavioral health services. The General Counsel collectively addresses the full range of the Company’s legal matters, including but not limited to business contracts, managing healthcare related litigation, regulatory and reimbursement issues, fraud and abuse laws, medical malpractice claims, risk management, patient relations, corporate transactions and governance, real estate, intellectual property, and labor and employment issues.

RESPONSIBILITIES

  • Negotiate, draft, and review contracts and other legal documents, including real estate leases, property and asset acquisition documents, purchasing, joint ventures, managed care, physician employment matters and services, licenses and other intellectual property agreements and financing documentation.
  • Supervise and direct outside counsel retained on behalf of the Company or one or more of its subsidiaries.
  • Provide counsel on a variety of legal issues, including health care laws, including those on privacy, Medicare, Medicaid and other government programs, fraud and abuse, physician self-referral and anti-kickback laws, and EMTALA.
  • In collaboration with compliance staff, develop compliance policies and procedures, and work closely with compliance to investigate and resolve compliance concerns.
  • Provide guidance on revenue cycle matters, including collection and third-party liability issues.
  • Provide guidance on billing and other reimbursement matters for compliance with government and commercial health plan requirements.
  • Advise executives within the Company and work alongside employees in various business lines, such as HR.
  • Provide counsel on medical staff matters, including bylaws, medical staff corrective action, and peer review and disciplinary actions of medical staff.
  • Provide counsel for all legal issues regarding patient care, including informed consent, medical records/privacy issues, and patients' rights issues.
  • Perform other duties as required.
  • Ability to work both independently with minimal supervision and/or collaboratively in a team setting.
  • Effective leadership skills which demonstrate the ability to participate in innovation and change, think strategically and solve problems.
  • Superior communication skills in both written and verbal presentation, including all aspects of legal writing technique and procedure, and the ability to convey complex legal concepts to non-lawyers.
  • Experience in fraud and abuse, physician self-referral, anti-kickback, privacy, billing and reimbursement, and patient care issues preferred.
  • Knowledge of laws and accreditation standards governing the delivery of healthcare by providers and suppliers, including hospitals preferred.

QUALIFICATIONS

Education

Juris Doctor degree from an accredited law school and a member of good standing of the New York bar.

Work Experience

At least five (5) years of experience in the corporate healthcare practice of a law firm.
