Your role:

You will serve as Firefly’s legal expert and in-house counsel for all matters related to health care regulation, contracting, and partnerships. As part of the leadership team, you will advise other Firefly leaders on risk and risk mitigation related to regulation, contracting, and partnerships. This may include state and federal laws around licensure, prescribing, ERISA regulations, the corporate practice of medicine, anti-kickback and related laws, CMS regulations, HIPAA, among others. You will be responsible for assessing contracts with partners including payers, network providers, employers, vendors, and stop-loss carriers. You will provide legal and strategic advice as we develop a full benefit solution in the self-insured space to employers of all sizes, including the development of health care captives.

Beyond legal advice, you will work closely with the Founder/Chief Network Officer and other members of senior leadership to develop and execute our network and partner strategy. In this capacity, you will represent Firefly as you source, initiate, negotiate, and manage key partnerships in the payer, provider, and vendor community.

What you will do:

Partnerships and contracts

Provide strategic input into key partnerships, assessing legal risk and opportunities

Draft and/or review all contracts with providers, payers, and other potential partners or vendors

Draft and/or review contracts with self-insured employers and all partners entering into Firefly full benefit agreements

Lead contract negotiations with partners and potential partners

Help Firefly teams ensure appropriate management of partnerships according to contracts

Regulation

Assess regulatory risk in each state in which Firefly practices or intends to practice

Corporate practice of medicine

Scope of practice for nurse practitioners, physicians assistants, medical doctors, social workers, unlicensed coaches

ERISA and similar state-level regulations governing health plans

Advise on decisions and management related to regulations, applying judgment to legal risk vs. business need

Assist Firefly team members in other departments (tech, product, clinical, operations) with regulatory questions

Compliance

Serve as Firefly’s privacy officer for HIPAA and advise on HIPAA and related questions and issues

Other legal work

Liaise with outside counsel when outside counsel is needed, such as for HR issues, fundraising

You’d be a good fit if you:

Have a law degree with at least 10 years of experience practicing health care regulatory law

Have passed the Massachusetts bar

Have excellent communication skills

In-house counsel experience preferred
