General Summary:

The General Counsel is responsible for overseeing all legal matters related to the Company's operations. This position plays an integral role in ensuring compliance with applicable laws and regulations while also providing strategic legal advice to Executive Leadership.

Essential Duties:

  • Ensure that all aspects of the Companys operations comply with relevant federal, state, and local laws and regulations governing the debt settlement industry, including but not limited to the FCRA, CFRB, UDAAP, TCPA, TSR, and FDCPA, in addition to state-specific regulations.

  • Stay abreast of changes in legislation and regulatory requirements impacting the debt settlement industry, assess their potential impact on our operations, and develop and implement strategies to maintain compliance.

  • Review, draft, and negotiate contracts with clients, creditors, affiliates, vendors, and other third parties to ensure that our legal interests are protected and that agreements are in compliance with applicable laws and regulations.

  • Manage all aspects of litigation and legal disputes involving the Company, including working with external counsel, overseeing discovery processes, and developing strategies for resolution.

  • Identify legal risks and vulnerabilities within our operations and develop strategies to mitigate and manage these risks effectively.

  • Advise on the development and implementation of internal policies and procedures to ensure consistent compliance with legal and regulatory requirements.
  • Work in tandem with external attorneys to best address legal matters that are impacting the organization.
  • Collaborate with internal department Leadership to ensure best practices are implemented to mitigate levels of risk.

  • Offer guidance to internal departments on how best to navigate circumstances which pose a legal risk for the Company.

  • Provide legal advice and support to Executive Leadership on corporate governance matters, including board governance, corporate structure, and regulatory reporting requirements.

  • Establishes and maintains effective working relationships with external parties such as affiliates and industry partners when working on collaborative initiatives.

  • Works closely with Executive Leadership to ensure departmental initiatives align with the Companys long-term vision.

  • Promote a culture of ethics and integrity throughout the organization; Investigate and respond to reports of potential ethical violations.

Knowledge and Experience:

  • Juris Doctor (J.D.) degree from an accredited law school and admission to the bar in the relevant jurisdiction.

  • Valid and active license to practice law in the state of California.

  • Minimum of 10 years of experience practicing law, with a focus on regulatory compliance, contract law, and litigation management within the financial services industry.

  • Strong understanding of federal and state laws and regulations governing the debt settlement industry, including the FCRA, UDAAP, TCPA, TSR, FDCPA, CFPB, and state licensing requirements.

  • Excellent analytical, problem-solving, and decision-making skills, with the ability to provide practical legal advice in a fast-paced environment.

  • Effective communication and interpersonal skills, with the ability to collaborate with cross-functional teams and communicate complex legal concepts to non-legal stakeholders.

  • Strong organizational skills and attention to detail, with the ability to manage multiple priorities and deadlines effectively.
  • Prior experience working in the debt settlement industry or a related field is preferred.

Salary Range:

  • $190,000 - $210,000 depending on experience

Job Type:In-Office on a 3-day hybrid schedule

Schedule: 8-hour shift, Monday to Friday
