Position Overview

Katapult is seeking a General Counsel and Head of Compliance to provide legal leadership, provide guidance for product and commercial programs and guide the company’s compliance programs with a focus on applicable federal and state consumer financing regulations. The ideal candidate will approach the role with enthusiasm, passion and common sense while being able to spearhead critical initiatives, provide insight and advice to the leadership team and build a strong team/partner framework for our legal and compliance needs. The ideal candidate will have demonstrable experience leading the legal and compliance infrastructure and execution, preferably within a growing fintech organization.

Primary Job Duties

Support leadership on strategic decisions regarding business evolution, product expansion, partnerships, and general execution of the business strategy

Managing internal and external legal resources and partners related to legal and compliance activities

Research and report on legal and regulatory updates and developments

Supporting the business on general commercial contracts, drafting and negotiation, including but not limited to software & services agreements with partner and merchants, terms & conditions, NDAs and/or IT/IP agreements

Draft and review partnership agreements with payment services providers, e-commerce platforms and other technology providers, and agreements with key IT and other inbound service providers

Provide legal support for internal functions, including sales, human resources, marketing, finance, support and IT at all levels of the business

Support focus on data protection & IP, including reviewing and negotiating agreements related to data processing and supporting data privacy processes, policies and issues

Lead all regulatory audits, including conducting annual internal compliance audits, and meet with regulators on exams and other regulatory matters

Identify potential areas of compliance vulnerability and risk and coordinates mitigation strategies with department leaders

Overall responsibility to evaluate Katapult’s services and operations for compliance issues and design and implement a national compliance program

Ensure compliance with applicable federal and state-level regulations and other applicable consumer protection law regulations for Katapult’s offices and business

Assess, identify, monitor, and document regulatory risks

Develop compliance controls and provide guidance that balances regulatory requirements, risk mitigation and business objectives

Qualifications

Bachelor's degree and JD from accredited institution

7-10+ years of legal experience in commercial legal role

7+ years of experience working with/at financial institutions or related regulatory experience

Preferred experience in lease-to-own regulations, consumer installment, payments or other applicable financing service businesses

Must have strong personal computer and communication skills and a demonstrated ability to operate as part of a distributed team (remotely)

Natural problem solver and commercially focused

Excellent judgment and analytical skills
